Residents in town with flood of new apartment projects appeal approval of mixed-use multifamily development

A group of residents is appealing an approval of a plan to build a four-story, 40-unit apartment complex with retail space in Fairfield.

The 10 residents, led by Marie Mollo, have filed a lawsuit in state Superior Court in Bridgeport against the town’s Planning and Zoning Commission for its April 8 approval of the project, slated for a 0.7-acre parcel, at 2179 and 2179 Post Road and 29 Fairfield Place.

The commission and the applicant, Fairfield-based Sunshine Acquisition Group, or their attorneys, have been summoned to appear in court on June 24, according to the suit.

The suit listed several reasons why the approval is “illegal, arbitrary and capricious and in abuse of the powers vested” in the commission, including the development’s adverse impact on access to and value of plaintiffs’ nearby properties. The project will also negatively affect the health and safety of the plaintiffs and their families due to, among other things, increased traffic and inadequate parking, the suit alleges.

“Unfortunately, an appeal for the mixed-use approval has been filed by our neighbors,” Marc Andre, a Sunshine Acquisition Group principal, told the Hartford Business Journal. “We will not be making any comments on pending litigation or our current application until a decision has been rendered.”

A call to the town’s Planning and Zoning Department was not immediately returned.

The development, which was proposed in August 2024, will contain 39,742 square feet of residential space, 28,549 square feet of garaged parking and 9,474 square feet of retail space. The project, which will be named Le Andre, will feature an outdoor plaza and dog run.

The 40 apartments – eight of which will be deemed affordable housing – will all be one-bedroom units, according to an application filed with the town.

Meantime, Sunshine Acquisition Group in September proposed a separate proposal for the property that entails erecting a 60-unit, five-story apartment building that will have 18 affordable units through the state’s 8-30g statute.

The building would contain 59,626 square feet of space. The property would also have two parking garages with a total of 75 spaces and 29,975 square feet of space.

The Planning and Zoning Commission opened a public hearing on that project on Tuesday.
